1. All LanguageCorps Applicants must read and accept this statement of Terms and Conditions as a requirement of the Application process.
2. As part of our screening and application process, Applicants are required to complete the LanguageCorps Application, which includes basic personal information, a brief summary of their personal history and background, a statement of their motives for joining LanguageCorps, and objectives for teaching EFL overseas. Falsification of information is reason for dismissal from the program.
3. Once LanguageCorps accepts your Application, a US$500 deposit is required to reserve your place in the program. This deposit is deducted from the total program fee, and is refundable for 3 business days after receipt (minus a $25 processing fee), after which it is non-refundable. Due to enrollment constraints, deposits received within 60 days of a program start date are non-refundable. Once the deposit is received, you will be registered for your preferred start date and sent pre-departure information.
4. Payment of the balance of all Program Fees is due in full no later than twenty (20) business days prior to your scheduled start date.
5. If for any reason you wish to cancel your plan to join LanguageCorps after a portion or full fees (i.e. deposit plus balance) have been paid, LanguageCorps cannot provide any refund except for exceptional circumstances, at our sole and final discretion. This includes an early return prior to the conclusion of your training program. In any event, the deposit is non-refundable unless intent to withdraw from the program is received within 3 business days from receipt of deposit. Depending upon the circumstances, you may be given the option of completing the program at a later time.
6. It is agreed and understood that a successful overseas adventure requires mutual cooperation and effort on the part of LanguageCorps and you.
7. It is understood that international travel including travel to, from and within the foreign country(s) where the program is located, your chosen school, accommodations, and any in-country excursions have inherent risks that you may be exposed to and possibly harmed by. You should consider safety, current affairs, and personal health before committing to any international travel. LanguageCorps is not responsible for risks related to international travel including but not limited to international law, local custom, transportation risk, employment risk, health risk, personal injuries property damage, accidents involving motor vehicles, aircraft and other forms of transportation, riots, political instability, crime, acts of terrorism, detention by government authorities or individuals, burglary, assault, encounters with dangerous wildlife, other hazards, sexual, racial and ethnic preference and/or discrimination of international providers and organizations. Program participants may travel to remote rural areas and may lodge and eat with the residents in those areas. As such, the accommodations, food and sanitary conditions may be below, or substantially below, customary standards in the United States or other developed nations. Healthcare facilities, medical supplies and medical personnel on the program may be very limited and, if available at all, may be below or substantially below U.S. or other developed nations standards.
8. You understand that LanguageCorps may have contracted with independent local organizations, outfitters, suppliers and vendors ("Vendors") for the provision of certain aspects of the program, including, accommodations, food and excursions, and that LanguageCorps does not own or operate any of these Vendors. While LanguageCorps has used its best efforts to select reliable and safe Vendors, LanguageCorps is not responsible for any negligent or willful act or omission of a Vendor or other third party, and you hereby release LanguageCorps from all claims arising out of, or related to, the willful or negligent acts or omissions of these Vendors.
9. For the LanguageCorps Flagship Program, the following terms apply:
a. LanguageCorps will not reimburse any of the program fee if you resign early or quit a teaching position before your contract has ended. A resignation for family illness or emergencies, or your own illness, will receive due consideration by LanguageCorps for reimbursement of any unused portion of the fee paid, at the sole discretion of the management of LanguageCorps and depending upon the circumstances, you may be given the option of completing the program at a later time.
b. There will be no refund of the program fee for “termination with cause”.
c. The LanguageCorps Program presumes your satisfactory completion of all TESOL Training and Certification requirements (including Teaching Practices) within approximately 4-5 weeks, and placement into an acceptable paid EFL teaching assignment within a reasonable timeframe thereafter.
d. If for any reason other than your voluntary withdrawal from the program or your dismissal due to disciplinary or other serious issues, you do not satisfactorily complete training and earn your certification within the established period, LanguageCorps may offer an extension of time for further Training and/or Teaching Practice. However, the cost of accommodations will be your responsibility for the duration of your time extension. If the TESOL Training and Certification is not completed satisfactorily within a reasonable amount of time, LanguageCorps will deem that all of our responsibilities to you have been met in full, will retain all fees paid, and will assume no further obligation to provide job placement services to you.
e. If, after your satisfactory completion of Training and Certification, LanguageCorps attains one or more reasonable paid EFL teaching assignment(s) for you, but you decide for any reason not to accept any assignment, LanguageCorps will deem that all of our responsibilities to you have been met in full, will retain all fees paid, and will assume no further obligation to provide job placement services to you.
f. If, after all reasonable efforts, LanguageCorps is unable to attain a paid EFL teaching assignment for you and you choose to return home, we will refund the remaining portion of your fee that has not been paid on your behalf to other providers of products and services, and will work with you to arrange return travel home.
g. If you withdraw from the training course into which you were originally assigned, and wish to re-enter a course at a later time, an additional fee may be required.
h. You understand that job placement is focused on specific geographic areas in each country and that the Corps Advocate support is limited to those areas. If you choose to leave the specified geographic area that is focused on, you will do so at your expense, and we will not be responsible for guaranteed job placement or Corps Advocate support. You understand and agree that, by accepting a paid EFL teaching assignment, you must comply with all work rules and practices as defined by that school. While LanguageCorps staff will work with you to locate and evaluate paid assignments, the final decision to accept or reject an assignment is yours to make. At no time during your training period or teaching assignment will you be, or will you be considered, an employee of LanguageCorps.
i. In most countries, LanguageCorps staff will work with you, and with the hiring school, to facilitate the process of acquiring a valid “work visa” as may be required by the country in which you accept your paid teaching assignment. You agree that you will participate proactively and cooperatively as necessary to complete this important process; and you agree to comply with all requirements and pay any additional fees, if any. If work visas are not normally obtained by the hiring schools in a country, we will advise you on how to legally live and work in the country.
j. All participants are subject to the disciplinary regulations of the Training Center, LanguageCorps, and their hiring schools, and to standards of reasonable, professional behavior as exemplified and required by LanguageCorps staff and hiring schools. Violation of these standards can lead to disciplinary action, up to and including termination from the program. In these regards, the decisions of our Course Directors and other LanguageCorps staff are final. You agree to abide by all restrictions, terms and conditions that may apply to your use of services provided by LanguageCorps (examples: cell phone service, Internet access and Email, etc.); and in general, you agree to act responsibly and with due consideration for others.
10. Regarding LanguageCorps’ cancellation of courses: if for some unforeseen reason LanguageCorps is compelled to cancel a course, we will allow any participants who had registered and paid for the canceled course to enroll in a future course at no additional cost.
11. You must understand clearly that while you are living and working in any foreign country, you are subject to all its local laws and ordinances. While LanguageCorps may lend informal advice or support in some fashion at our sole discretion, under no circumstance will we bear any legal or other obligation to any participant who is found in violation of any local laws or ordinances. Illegal drug use is taken very seriously by most other countries, and LanguageCorps expects our teachers to not use any illegal substances or engage in other illegal activities while overseas.
12. You represent to LanguageCorps that, to the best of your knowledge, you are in good mental and physical health. You are voluntarily participating in the program, with knowledge of the risks and dangers involved. You expressly accept and assume all known and unknown risks on behalf of yourself.
13. In exchange, and in consideration for participation in the program, you hereby release LanguageCorps and its employees, agents, volunteers, officers, directors and representatives (each, a "Releasee") from any and all injuries, deaths, losses, liabilities, damages, claims, actions, suits and judgments whatsoever including costs, expenses and attorney fees (collectively, "Claims") that you may have now or in the future, directly or indirectly, arising from, connected with or related to your participation in the program, whether caused by any Releasee or some other person or cause. You agree that you will not, at any time, directly or indirectly, on behalf of yourself, your child and your heirs, commence or prosecute any action, suit or other proceeding against any Releasee arising from, connected with or related to our participation in the program. You agree to indemnify, hold harmless and defend each Releasee from and against any and all Claims whatsoever that the Releasee may suffer arising from, connected with or related to your participation in the program, whether inside or outside of the U.S.
14. You hereby grant full permission to LanguageCorps to use any photographs, videotapes, motion pictures, website images, recordings, comments you make in questionnaires or letters or any other record of the program for purposes of commercial advertising, marketing or promotional literature without the need for further consent from you. We will automatically enroll you in the LanguageCorps Newsletter, which is published approximately 4-6 times a year, upon receipt of your application. You can unsubscribe at any time.
15. The details of all programs are subject to change without notice at the sole discretion of LanguageCorps and its staff.
16. OUR CUMULATIVE LIABILITY TO YOU FOR ANY AND ALL CLAIMS OF ANY TYPE OR NATURE (WHETHER IN TORT, CONTRACT OR OTHERWISE) SHALL BE LIMITED, IN THE AGGREGATE, TO THE FEES PAID BY YOU TO US. UNDER NO CIRCUMSTANCES SHALL LANGUAGECORPS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, COVER, PUNITIVE OR CONSEQUENTIAL DAMAGES, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. UNDER NO CIRCUMSTANCES WILL WE BE LIABLE FOR ANY DAMAGES ARISING OUT OF EVENTS BEYOND OUR REASONABLE CONTROL.
17. These Terms and Conditions, and any other agreement you may enter into with LanguageCorps, shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, USA, without giving effect to principles of conflicts of law. You consent to the exclusive jurisdiction and venue of the courts of Middlesex County, Massachusetts, USA, for any dispute, claim or cause of action you may have, or proceeding you may wish to bring, against LanguageCorps, and you agree to waive any right to trial by jury regarding any such dispute, claim or cause of action.
